1. The publisher and the site
The site is operated by Independent Financial History Study and Journalism (“the publisher,” “we”). It is an independent educational archive documenting the history of The Wall Street Fund, Inc. and related institutions. The publisher is a separate entity from every organization documented on the site, as set out on the independence page, which forms part of these terms.
2. Nature of the content
All content is historical information and general education, provided for scholarship, journalism, study and public interest. Content is offered “as is” and “as available.” The publisher works to a documented methodology and a public corrections process, and states uncertainty where it exists. Readers making financial, legal or other decisions should rely on current official documents and qualified, licensed professionals. The site provides historical records and analysis; investment, legal, tax and accounting advice lie outside its scope, and every reader’s reliance on the content rests with that reader’s own judgment.
3. Permitted use
Readers may view, read, search, print and link to the site for personal, educational, scholarly and journalistic purposes. Readers may quote brief passages of the publisher’s original text with attribution to “The Wall Street Fund Archive, Independent Financial History Study and Journalism” and a link to the page cited. Structured data exports and citation formats are provided for that purpose.
4. Reserved rights
Original text, design, typography, diagrams, data structures and the compilation of the archive are the publisher’s copyright. Uses beyond those permitted in section 3 — including systematic copying, republication of substantial portions, commercial redistribution and automated bulk extraction — require the publisher’s prior written permission, which may be requested through the contact page. Public-domain government works and third-party public records remain subject to their own status.
5. Third-party names, marks and materials
Names and marks of funds, trusts, advisers, banks, law firms and other organizations appear solely to identify the subjects of the historical record and belong to their respective owners. Links to external sites are provided for reference; the destinations are governed by their own terms, and the publisher exercises editorial judgment only over its own pages.
6. Reader submissions
By submitting a correction, source, document or inquiry, a reader grants the publisher a perpetual, royalty-free licence to use the submission for the archive’s editorial purposes, including publication of corrected claims and correction-log entries, with attribution at the publisher’s discretion or at the submitter’s request for anonymity. Submitters confirm they hold the rights needed to make the submission. The contact page describes the categories of information the archive accepts.
7. Acceptable conduct
Readers agree to use the site lawfully and in a manner that preserves its availability to others. Conduct that interferes with the site’s operation, circumvents security or rate limits, misrepresents the publisher, or uses the site to solicit investments or collect financial information falls outside permitted use and may result in access being withheld.
8. Limitation of liability
To the fullest extent permitted by law, the publisher’s aggregate liability to any reader arising from use of the site is limited to the amount that reader paid the publisher for access, which for this free archive is zero. The publisher’s warranties are limited to those that applicable law makes incapable of exclusion. Any dispute is limited to direct damages actually incurred.
9. Indemnity
A reader who uses the site in breach of these terms agrees to indemnify the publisher against claims, losses and reasonable costs arising from that breach.
10. Changes
The publisher may revise these terms; the effective date above will change when it does, and material revisions will be noted in the correction log. Continued use after a revision signifies acceptance of the revised terms.
11. Governing law and forum
These terms are governed by the laws of the State of New York and the federal laws of the United States, with exclusive jurisdiction in the state and federal courts located in New York County, New York. Where a court finds any provision unenforceable, the remainder continues in effect.
